Welcome to BookNova.ai. These Terms of Service ("Terms") govern your access to and use of our automated PDF book generation service. By accessing or using BookNova.ai, you agree to be bound by these Terms.

1. Service Description

BookNova.ai is an AI-powered automated PDF book generator that provides the following services:

  • Automated Content Generation: AI-generated book chapters with intelligent structure and professional writing quality
  • Customization Options: Control over book length, quality level, expertise level, tone, and language (many languages supported)
  • AI Image Generation: Optional AI-generated images to enhance chapter content
  • Professional Cover Designs: Multiple cover templates including Modern, Tech, Minimal, Nature, Energy, and Creative themes
  • Smart Table of Contents: Automatically generated hierarchical chapter structure
  • PDF Export: High-quality PDF generation with customizable page sizes and quality settings
  • Multi-Language Support: Content generation in many languages

2. Account and Access

2.1 Account Registration

To use BookNova.ai, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 Eligibility

You must be at least 18 years old to use our service. By using BookNova.ai, you represent and warrant that you meet this age requirement.

2.3 License to Use

Subject to your compliance with these Terms, IMAGE LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use BookNova.ai for your personal or commercial purposes.

3. Payment and Subscription

3.1 Pricing

BookNova.ai offers a lifetime access model with a one-time payment. Current pricing is displayed on our website and is subject to change at our discretion for new purchases. Your purchased access rights remain valid regardless of future price changes.

3.2 Payment Processing

All payments are processed securely through Paddle, our Merchant of Record. By making a purchase, you agree to Paddle's terms and conditions. We do not store your payment card information.

3.3 Refund Policy

We offer a 30-day money-back guarantee. If you are not satisfied with BookNova.ai within 30 days of purchase, you may request a full refund by contacting [email protected]. Refunds are processed within 5-10 business days.

4. Intellectual Property Rights

4.1 Content Ownership

You retain all rights to the books and content you create using BookNova.ai. IMAGE LLC does not claim ownership of your generated content.

4.2 AI-Generated Content

Content generated by our AI systems is provided to you for your use. While we use advanced AI technology, you are responsible for reviewing, editing, and ensuring the accuracy and appropriateness of all generated content before publication or distribution.

4.3 Platform Rights

BookNova.ai, including its software, algorithms, design, trademarks, and all related intellectual property, remains the exclusive property of IMAGE LLC. You may not copy, modify, distribute, or reverse engineer any part of our platform.

4.4 License to Generated Content Is Conditional on Payment

Although you retain ownership of the books and content you create, your right to use, publish, distribute, sell, or otherwise commercially exploit that content (including books, drafts, chapters, text, AI-generated images, and exported PDF files, collectively "Generated Content") is granted in exchange for, and conditional upon, your retained paid access to BookNova.ai.

If you request and receive a refund, this license is automatically and retroactively revoked. From that point you may no longer publish, distribute, sell, or upload any Generated Content on any platform — including Amazon Kindle Direct Publishing (KDP) and similar e-book, print-on-demand, and audiobook services — even if you have edited, rewritten, translated, or otherwise modified it. A work derived from Generated Content remains subject to this restriction regardless of how much it has been changed. Continuing to use Generated Content after a refund is a material breach of these Terms and unauthorized use of our service. Full details, including the remedies available to us, are set out in our Refund Policy (Sections 4.4 and 4.5).

4.5 You Are the Author of Your Books

Every book, chapter, character, plot, and image produced through BookNova.ai originates from instructions that you supply. You choose the premise. You write or approve the story bible. You define the characters and their ages. You select the genre, tone, language, heat level, and content rating. You write the custom instructions, and you supply any text you paste into the service. BookNova.ai applies your instructions to general-purpose artificial intelligence models; it does not originate subject matter of its own and does not decide what your book is about.

Accordingly, and for the avoidance of any doubt:

  • You are the author and originator of all Generated Content created in your account, and you accept authorship of it for all purposes, including in relation to any third party, court, regulator, retailer, or public authority.
  • IMAGE LLC is not the author, co-author, ghostwriter, editor, publisher, imprint, or distributor of any Generated Content. We do not commission, write, review, approve, curate, endorse, or select the content produced for you, and we exercise no editorial judgment over it.
  • The decision to publish is yours alone. Content generated in your account and never published is your private draft. Content you publish is your publication, made on your own initiative, under your own name or pen name, on platforms of your choosing, on terms you agree with those platforms.
  • This allocation of authorship and responsibility applies regardless of which party's technology produced any particular sentence, paragraph, or image, and regardless of how little or how much you edited the output before publishing it.

4.6 Our Role Is Technical and Intermediary

BookNova.ai is a self-service software tool and hosting service. In respect of the material you submit and the Generated Content stored in your account, we act as a provider of an intermediary hosting service within the meaning of Regulation (EU) 2022/2065 (the Digital Services Act) and the Latvian law implementing it. We do not initiate the generation of any book, do not select the user for whom it is generated, and do not select or modify the subject matter of what is generated, save for the automated safety screening described in Section 5.5.

The screening described in Section 5.5 is a safety measure we carry out voluntarily and in good faith. Consistent with Article 7 of the Digital Services Act, carrying out such own-initiative measures does not make us the author, originator, or publisher of any content, does not give us actual knowledge or awareness of unlawful content that the screening did not identify, and does not deprive us of any exemption from liability available to intermediary service providers.

4.7 You May Not Attribute Your Work to Us

You may not name, credit, list, or register BookNova.ai or IMAGE LLC as the author, co-author, writer, contributor, publisher, imprint, copyright holder, or rights holder of any Generated Content. This applies to the work itself, its front and back matter, its cover, retailer and distributor metadata (including Amazon KDP, IngramSpark, Apple Books, Google Play Books, and Kobo), copyright registrations, ISBN records, catalogue entries, press material, and advertising.

You may truthfully state that a work was created with the assistance of artificial intelligence, and you must do so wherever a platform or applicable law requires such a disclosure (see Section 5.6). You may not, however, make any statement that suggests we wrote, reviewed, approved, vetted, or endorsed your work, or that we bear responsibility for its content.

You may not use our name, logo, or trademarks on or in connection with published Generated Content without our prior written permission. If a work is published in breach of this Section, you must correct the attribution, metadata, and registrations promptly upon written notice from us, at your own cost, and the indemnity in Section 10 applies in full to any claim, cost, or proceeding arising from the incorrect attribution.

4.8 AI Output Is Not Guaranteed to Be Unique or Protectable

Artificial intelligence models produce similar output from similar input. We do not warrant that Generated Content is unique or original, or that identical or substantially similar content has not been and will not be generated for another user. We do not warrant that Generated Content is free of third-party rights, or that it is eligible for copyright protection in any given jurisdiction — the legal status of AI-generated material differs between countries and remains unsettled in many of them. Verifying the position in every jurisdiction in which you publish is your responsibility.

5. User Responsibilities, Prohibited Content, and Acceptable Use

5.1 Adult Fiction Is Permitted — Within Limits

BookNova.ai is a fiction-writing platform for adults. We do not require your stories to be tame: mature themes, graphic violence, dark subject matter, and explicit sexual content are all permitted in fiction, provided that:

  • You are at least 18 years old (see Section 2.2);
  • Every character depicted in, implied by, or participating in sexual or sexually suggestive content is an adult aged 18 or over, and is described as such throughout your project; and
  • The content does not fall into any category listed in Sections 5.2 or 5.3 below.

Difficult themes may be the subject of a serious work of fiction — a crime novel may investigate abuse, a war novel may portray atrocity, a dark romance may portray coercion. What is prohibited is content that presents such acts as endorsed, gratifying, instructional, or aspirational rather than as narrative subject matter, and any content in Section 5.2 regardless of framing, literary merit, or claimed artistic intent.

5.2 Absolutely Prohibited Content — Zero Tolerance

The following are prohibited without exception. There is no artistic, satirical, educational, research, or "it is only fiction" exemption. Any of the following results in immediate termination under Section 5.7:

  • Any sexual or sexualized depiction of a minor. This includes any character under the age of 18, whether real or fictional, human or non-human, and regardless of species, magical age, immortality, reincarnation, or similar framing. It includes characters described with childlike physical characteristics or in child-coded roles (schoolchild, pupil, "little girl/boy", pre-teen), "aged-up" or "ageless" characters presented in a childlike manner, and any romantic or sexual pairing between an adult and a minor.
  • Child sexual abuse material (CSAM) in any form, including text, prompts, story bibles, character descriptions, and AI-generated images.
  • Content depicting the grooming, sexual trafficking, sexual slavery, or sexual commodification of minors, including framing a minor as sexually available, purchasable, or "saved for" an adult.
  • Sexual content involving real, identifiable persons (public figures included) without their documented consent.
  • Sexual content involving animals (bestiality) presented realistically.
  • Content that provides genuine, actionable instructions for mass-casualty harm — including the synthesis, acquisition, or deployment of chemical, biological, radiological, or nuclear weapons, or explosive devices — irrespective of the fictional wrapper it is placed in.
  • Content constituting material support for terrorism or that promotes, glorifies, or recruits for terrorist or violent extremist organizations.

Enforcement note: our systems automatically reject any project rated "mature" or "explicit" in which a character is stated or implied to be under 18 years of age. If your story legitimately features a minor character, keep the project within a non-explicit rating, or age the character to 18 or over.

5.3 Other Prohibited Content and Uses

You further agree not to use BookNova.ai to generate, request, store, or distribute:

(a) Illegal or dangerous content

  • Genuine, actionable instructions for manufacturing weapons, untraceable or 3D-printed firearms, or illegal drugs
  • Functional malicious code, exploits, malware, ransomware, or hacking tools
  • Content facilitating human trafficking, sexual exploitation, or the abuse of vulnerable persons
  • Content that encourages, instructs in, or romanticizes suicide, self-harm, or eating disorders in a manner likely to cause real-world harm
  • Content violating any applicable law, regulation, sanctions regime, or export control

(b) Hate, harassment, and abuse

  • Content that incites, promotes, or celebrates hatred, dehumanization, or violence against an individual or group on the basis of race, ethnicity, national origin, immigration status, religion, sex, gender identity, sexual orientation, disability, age, or any other protected characteristic
  • Harassment, bullying, threats, stalking, or doxxing directed at a real person
  • Content that denies or trivializes documented atrocities or genocide

(c) Real people and privacy

  • Defamatory statements about real, identifiable persons presented as fact
  • Impersonation of a real person or organization, fabricated quotations or endorsements presented as genuine, or content falsely attributed to a real author
  • Disclosure of another person's private information (home address, contact details, identification numbers, medical, financial, or biometric data)

(d) Deception and infringement

  • Content that infringes the copyright, trademark, moral rights, publicity rights, or other rights of any third party, including submitting substantial portions of a third party's copyrighted work as input
  • Disinformation presented as fact, including fabricated news, forged documents, and false claims regarding elections, voting, or public health
  • Spam, phishing, fraudulent solicitations, or mass-produced content generated to manipulate search rankings, app stores, or retail platforms
  • Content presented to readers as professionally verified medical, legal, financial, or safety advice

(e) Platform abuse

  • Attempting to circumvent security measures, content filters, rate limits, credit limits, or usage restrictions, including through prompt injection, jailbreaking, obfuscation, encoding, or splitting prohibited content across multiple requests
  • Reselling, sublicensing, sharing account credentials, or redistributing access to BookNova.ai without our written permission
  • Using automated scripts, bots, or scraping tools to abuse, overload, or extract data from our service
  • Using our prompts, outputs, or Generated Content to train, fine-tune, evaluate, or benchmark a competing AI model or service
  • Reverse engineering our prompt library, model orchestration, or system architecture (see Section 4.3)

(f) Post-refund use

  • Requesting or receiving a refund and thereafter continuing to publish, distribute, or sell any content generated with BookNova.ai, including modified or derivative versions of that content (see Section 4.4 and our Refund Policy)

5.4 Third-Party AI Provider Policies Apply to You

BookNova.ai generates content using third-party artificial intelligence providers, which currently include Google (Gemini), OpenAI, Anthropic (Claude), DeepSeek, Together.ai, and Replicate, and which we may add to, change, or replace at any time without notice.

Your use of BookNova.ai is additionally subject to the usage and content policies of whichever provider processes your request. Any content prohibited by the applicable provider's policy is prohibited on BookNova.ai, even where it is not expressly listed in these Terms. Those policies are set by the providers, may change without notice to you, and are outside our control.

A provider may refuse, filter, truncate, or block any request at its sole discretion. We cannot override, appeal, or guarantee the outcome of such decisions, and a provider refusal does not constitute a failure of our service.

5.5 Automated Content Screening

We operate automated screening — including keyword matching, pattern detection, and AI-based classification — on the material you submit (premises, story outlines, story bibles, character data, custom instructions, and image prompts) and on the content our systems generate.

  • We may block, suspend, refuse to process, or delete any project that our screening, or a provider's safety filter, identifies as violating these Terms, with or without prior notice.
  • A blocked project is not a defect in the service. Blocking does not entitle you to any refund beyond the 30-day guarantee in Section 3.3, and any credits or generation capacity consumed before a block was applied are not automatically restored, although we may restore them at our discretion where a block resulted from our own error.
  • We may retain records of blocked projects, including the submitted inputs and the screening result, where necessary to comply with legal obligations, to enforce these Terms, and to prevent recurrence, as described in our Privacy Policy.
  • Screening is imperfect in both directions. Legitimate content is occasionally blocked, and prohibited content is occasionally not detected. The absence of a block is not approval, endorsement, or any warranty that your content is lawful or publishable in your jurisdiction. You remain solely responsible for it.

Save for the automated screening described in this Section, we do not review generated content and are under no general obligation to monitor the material stored or generated on our platform. This does not limit our right to act upon any notice or report we receive.

5.6 Your Responsibility for Generated Content

You are solely responsible for all content you generate, publish, or distribute using BookNova.ai. This includes:

  • Reviewing and editing content before publication (see Section 8);
  • Ensuring the content complies with the terms of every platform you publish on, including Amazon KDP, IngramSpark, Apple Books, Google Play Books, Kobo, and any other retailer or distributor;
  • Making any AI-content disclosure required by those platforms or by applicable law; and
  • Ensuring the content is lawful in every jurisdiction in which you publish it.

We are not liable for any claims, damages, account terminations, delistings, or legal issues arising from your use of generated content. Your indemnity obligations under Section 10 apply in full.

5.7 Enforcement

Where we reasonably believe these Terms have been breached, we may take any of the following actions, proportionate to the breach, with or without notice: issue a warning; block or delete the affected project or content; restrict features; suspend your account; or terminate your access permanently.

A breach of Section 5.2 results in immediate termination without notice and without refund. In such cases we will preserve the relevant account records and content, and will report the matter to law enforcement and/or the competent child-protection authorities where we are required or permitted to do so by law.

Termination for breach of this Section 5 is a termination for cause. It does not entitle you to any refund, and the licence to use Generated Content described in Section 4.4 is revoked upon such termination on the same terms as it is revoked upon refund.

5.8 Reporting Violations and Rights-Holder Notices

Any person or entity may notify us of content generated or stored on BookNova.ai that they consider unlawful or in breach of this Section, by email to [email protected] with the subject line "Content Report".

So that we can act on it, a notice should contain:

  • A sufficiently substantiated explanation of why the content is unlawful or in breach of these Terms;
  • A clear indication of where the content can be found — a URL, book title, project reference, account, or published listing;
  • The name and email address of the person submitting the notice (not required where the report concerns child sexual abuse material); and
  • A statement that the information in the notice is, to the best of that person's knowledge, accurate and complete.

We process notices in a timely, diligent, non-arbitrary, and objective manner, confirm receipt where contact details are provided, and inform the notifying party of the decision taken. We notify the affected user of any removal or restriction and the reasons for it, unless notification is prohibited by law or would obstruct the investigation of a serious criminal offence. We terminate the accounts of users who repeatedly provide manifestly illegal content, and we may suspend, after prior warning and for a reasonable period, the handling of notices from parties who frequently submit manifestly unfounded ones.

5.9 Your Representations and Warranties

Each time you submit an instruction or input, and each time you generate, export, or publish content, you represent and warrant to us that:

  • You are at least 18 years of age and have full legal capacity to enter into these Terms;
  • Every character depicted in, implied by, or participating in sexual or sexually suggestive content in your project is an adult aged 18 or over;
  • You hold all rights necessary in any material you submit, paste, or upload, and your inputs do not infringe the intellectual property, privacy, publicity, or other rights of any third party;
  • Neither your instructions nor your intended use of the output breaches Section 5.2 or 5.3, any applicable law or regulation, or any applicable sanctions or export-control regime;
  • You are not located in, resident in, or acting on behalf of any person or entity in a territory subject to comprehensive EU, United Nations, or other applicable sanctions, and you are not a person listed on any applicable restricted-party list; and
  • You will review the output before publishing it and will accept responsibility for it as its author.

These warranties are given by you personally, are relied upon by us in providing the service to you, and survive the termination of your account.

6. Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using BookNova.ai, you consent to our data practices as described in the Privacy Policy.

We store your book projects and generated content securely on servers located within the European Union, in compliance with GDPR regulations.

7. Service Availability and Modifications

7.1 Service Availability

While we strive to provide continuous access to BookNova.ai, we do not guarantee uninterrupted or error-free service. We may perform scheduled maintenance, updates, or emergency repairs that temporarily affect service availability.

7.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of BookNova.ai at any time, with or without notice. We are not liable for any modifications, suspensions, or discontinuations of the service.

7.3 Updates and Improvements

Lifetime access includes all future updates and improvements to the core book generation functionality. We may introduce additional premium features that require separate payment.

8. AI Content Disclaimer

Important Notice: BookNova.ai uses artificial intelligence to generate book content. While our AI technology is advanced, it may occasionally produce:

  • Inaccurate or outdated information
  • Grammatical errors or awkward phrasing
  • Content that requires fact-checking and verification
  • Repetitive or inconsistent sections

You are responsible for reviewing, editing, fact-checking, and ensuring the accuracy and quality of all AI-generated content before publication or distribution. IMAGE LLC is not liable for any errors, inaccuracies, or issues in AI-generated content.

9. Disclaimers and Limitation of Liability

9.1 Service Provided "As Is"

To the maximum extent permitted by applicable law, BookNova.ai and all Generated Content are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, whether express, implied, or statutory. We specifically disclaim the implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement, and we give no warranty that:

  • Generated Content will be accurate, original, unique, lawful, publishable, marketable, or accepted by any retailer or distributor;
  • Generated Content will be free of third-party rights or eligible for copyright protection (see Section 4.8);
  • The service will be uninterrupted, timely, secure, or error-free; or
  • Our automated screening, or any third-party provider's safety filter, will identify all prohibited or unlawful content (see Section 5.5).

9.2 No Liability for Generated Content or Its Publication

Without limiting Section 9.1, and to the maximum extent permitted by applicable law, IMAGE LLC shall have no liability whatsoever, to you or to any third party, in contract, tort, statute, or otherwise, for:

  • The subject matter, themes, characters, wording, imagery, accuracy, or lawfulness of any Generated Content;
  • Your decision to publish, distribute, sell, translate, adapt, narrate, or otherwise exploit Generated Content, and every consequence of that decision;
  • Any claim that Generated Content is defamatory, infringing, obscene, harmful, offensive, or otherwise unlawful;
  • Any action taken by a retailer, distributor, platform, marketplace, advertiser, or payment provider in respect of your work or your accounts with them, including rejection, removal, delisting, suspension, termination, or withheld royalties;
  • Any civil, administrative, regulatory, or criminal claim, investigation, or proceeding brought against you in connection with content you generated, attempted to generate, published, or distributed; or
  • Any content generated in breach of Section 5, whether or not our screening or a provider's filter detected it, and whether or not we had previously permitted similar content.

The fact that our systems produced text or images at your direction does not make us their author, publisher, or a party responsible for them. Sections 4.5, 4.6, and 4.7 govern the allocation of authorship and responsibility, and are to be read together with this Section.

9.3 Exclusion and Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • IMAGE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF BookNova.AI
  • OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US FOR ACCESS TO BookNova.AI
  • WE ARE NOT LIABLE FOR ANY LOSS OF DATA, LOST PROFITS, LOST ROYALTIES, LOST SALES, REPUTATIONAL HARM, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES
  • WE ARE NOT RESPONSIBLE FOR THIRD-PARTY CONTENT, SERVICES, AI PROVIDERS, RETAILERS, OR PAYMENT PROCESSING

These limitations apply even if we have been advised of the possibility of such damages and even if a limited remedy is found to have failed of its essential purpose.

9.4 Rights That Cannot Be Excluded

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for wilful misconduct or gross negligence, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, nothing in these Terms affects your mandatory statutory rights under Latvian or European Union consumer law. Where applicable law does not permit the exclusion of certain warranties or the limitation of certain liabilities, the exclusions and limitations in this Section apply only to the extent that law permits, and our liability is limited to the minimum extent permitted.

10. Indemnification

10.1 Your Indemnity

You agree to indemnify, defend, and hold harmless IMAGE LLC and its officers, directors, employees, contractors, and agents (the "Indemnified Parties") from and against any and all claims, demands, actions, investigations, proceedings, liabilities, damages, fines, penalties, settlements, costs, and expenses (including reasonable attorneys' fees and the reasonable cost of internal time spent responding) arising out of or relating to:

  • Your use of BookNova.ai and any instruction, prompt, story bible, character data, or other input you submit to it;
  • Any Generated Content you create, export, publish, distribute, sell, or adapt, including any claim that it is unlawful, infringing, defamatory, obscene, or harmful;
  • Your breach of these Terms, including any breach of Section 5 or of the representations and warranties in Section 5.9;
  • Your infringement or violation of the rights of any third party;
  • Any attribution of Generated Content to BookNova.ai or IMAGE LLC in breach of Section 4.7, and any consequence of such attribution;
  • Any claim, dispute, or enforcement action brought by a retailer, distributor, platform, or payment provider in connection with your work; and
  • Any request, order, subpoena, or investigation from a court, regulator, or law-enforcement authority that concerns your account, your inputs, or your Generated Content, including the cost to us of responding to it.

10.2 Conduct of Claims

We will notify you of any claim to which this indemnity applies. We may, at our option and at your expense, assume the exclusive defence and control of any such claim, in which case you will cooperate fully with us, provide all information and assistance we reasonably request, and preserve all relevant records. You may not settle any claim in a way that imposes any obligation, payment, restriction, or admission of fault or liability on any Indemnified Party without our prior written consent.

10.3 Survival

This indemnity is given in addition to, and does not limit, any other remedy available to us. It survives the termination, suspension, or deletion of your account and the refund of any amount paid, and continues to apply to any claim arising from your use of BookNova.ai before termination, however long after termination that claim is brought.

11. Termination

11.1 Termination by You

You may stop using BookNova.ai at any time. Termination does not entitle you to a refund beyond our 30-day refund policy period.

11.2 Termination by Us

We reserve the right to suspend or terminate your access to BookNova.ai immediately, without notice, if:

  • You violate these Terms
  • We reasonably believe your use of the service poses a security or legal risk
  • You engage in fraudulent activity or abuse of the service
  • Required by law or legal process

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Latvia, without regard to its conflict of law provisions.

12.2 Dispute Resolution
